Terms and Conditions regarding Usage and Ordering

Scope

These Terms and Conditions regarding Usage and Ordering apply to orders of products and services from this online shop and order processing between you and Georg Thieme Verlag KG. When references are made hereinafter to “we” or “us”, such references always refer to Georg Thieme Verlag KG.

This online shop’s offering is directed at doctors and other self-employed people in healthcare professions (physiotherapists, occupational therapists, naturopaths etc.) in single and group practices, or any other comparable facilities and companies in the healthcare sector who are not consumers as defined in article 13 of the BGB [German Civil Code].

Institutional customers who are not part of this group (e.g. hospitals, academic or public libraries, universities, local authorities) should contract eproducts@thieme.de if they wish to purchase our products.

Some of our products and services offered in this online shop are directed to a limited extent at consumers, as defined in article 13 BGB. Consumers can purchase all products that are processed via a single delivery or single download. Consumers cannot use this online shop to purchase subscriptions for magazines, databases, and other products for an indefinite term. If you are a consumer and would like to purchase a subscription of this type, please contact kundenservice.thieme.de.

Contracts can only be concluded with us in German.

Filling the shopping cart
Click on the “Put in shopping cart” button (“in den Warenkorb legen”) where you can place all the articles you wish to order. You can delete any products placed in the shopping cart by clicking the “Remove from shopping cart” button (“aus dem Warenkorb entfernen”). Continue ordering by clicking on the “proceed to checkout” (“weiter zur Kasse”) button.

Entering your customer data
To place your order, you can set up a user account, but this is not mandatory. Please enter all the customer data required to place your order. Required fields are marked with an asterisk. Please complete all the form.

If you decide to set up a user account, you can identify yourself when placing orders in the future by entering your e-mail address and your password. The data in your customer account will then already be filled in automatically. You can save and select shipping addresses that differ from your billing address. You can change these details at any time.

Click on the “continue” (“weiter”) button to proceed with the ordering process.

Checking and selecting the payment option
Select one of the payment options from the order completion page. You will be able to review your order and details provided before you complete your order. You can make changes by clicking on the “edit” (“Ändern”) link. If everything is correct, send the order by clicking the “confirm purchase” (“Zahlungspflichtig bestellen”) button.

Offering and acceptance
The range of products and services shown in this online shop are not considered an offering in the sense of articles 145 et seq. of BGB, but are an overview of all products and services with the non-binding invitation to order them.

By pressing the “confirm purchase” (“zahlungspflichtig bestellen”) button in this online shop and sending your order to us by e-mail, fax, phone, or other communication channels, you are promising to purchase our products. You will receive confirmation that your order has been received by e-mail (confirmation of receipt of order), which includes the information stated in the order. This confirmation of receipt of order does not imply that we accept your offer to purchase our products and services, but serves as information that we have received your order.

The contract comes into force when we have accepted your offer to purchase our products and services. Your offer is accept once we send order or shipping confirmation in a separate e-mail, an advance payment invoice (only when the payment type “Advance payment” – “Vorkasse” is selected) or when we supply the product or service you have ordered. If your order contains several items, a contract will only come into force for those products or services that are listed in the order or the shipping confirmation, or that are delivered.

Right of withdrawal, exclusion of the right of withdrawal
As a consumer, in the sense of the definition given in article 13 BGB, you have the right to withdraw from your contract within 14 days.

The right to withdraw from the contract does not apply to distance contracts to supply audio and video recordings, or to computer software in sealed packaging if the sealed packaging was removed after delivery.

The right to withdraw from the contract to deliver digital content, not captured on data media, e.g. e-books or other downloads, becomes null and void if we start executing the contract before the period in which you have the right to withdraw from the contract expires, as long as you have agreed and confirmed before the contract is executed that your right to withdraw from the contract becomes null and void as a result thereof.

Please observe the following cancellation policies regarding delivery of products, subscription contracts and for the delivery of digital content not on data media, and the cancellation form template for all contracts.

Right to withdraw from a contract
You have the right to withdraw from this contract within fourteen days without stating any reasons.

The period for cancelling the contract is fourteen days from the day on which you or a third party specified by you, who is not the party shipping the product or service, has received the last product or service ordered. You can, but do not have to use the cancellation form template attached.

To comply with the cancellation period, you just need to notify us that you are exercising your right to cancel before the cancellation period expires.

Consequences of cancelling the contract
If you cancel this contract, we undertake to refund all payments we have received from you, including the shipping costs (except the additional costs incurred because you have chosen a different method of shipping than the standard, cheapest shipping option we offer) immediately and within fourteen days from the day on which we received notification that you are cancelling this contract at the latest. To repay this amount, we will use the same payment option that you employed in the original transaction, unless any other option has been explicitly agreed with you; you will never however incur any additional charges due to this refund. We can refuse such refund until we have received the products, or until you have proved that you have returned them, depending on which of these dates is the earlier.

You must return or surrender the products immediately to us and always within fourteen days at the latest from the day on which you informed us you were cancelling this contract. Compliance with the cancellation period has been carried out if you send the products back to us before the fourteen-day period has expired. You must meet the direct costs of returning the products. You are only liable for any loss in the value of the products if such loss in value is due to an inspection of the quality, characteristics, and operation of the goods on your part that is unnecessary.

Special contractual conditions for certain products


E-books
You do not purchase ownership to the content concerned, but a simple non-transferable right to usage that entitles you to personal usage of the content. You are not permitted to forward such content to third parties, process, duplicate, reproduce, distribute, publish or make such content accessible to the public, regardless of whether in digital or analogue form.

DRM protection (Digital Rights Management) has been applied to e-books to protect them from piracy. Digital watermarks allow content to be identified and tracked if misused. Transferring e-books or other downloaded products to mobile devices or several computers might mean that special software is required to transfer and make use of such items. This software is not part of our contract with you, will not be supplied by us and can be subject to its own licensing and usage conditions.

Magazines
This online shop’s offering is directed at doctors and other self-employed people in healthcare professions (physiotherapists, occupational therapists, naturopaths etc.) in single and group practices, or any other comparable facilities and companies in the healthcare sector. Consumers (e.g. students or schoolchildren) as defined in article 13 BGB cannot purchase a subscription via this online shop. If you are a student or pupil of a school and would like to purchase a subscription of this type, please conact kundenservice.thieme.de.

Magazine subscriptions commence from the issue you have specified or from the next issue onwards if you have provided no details regarding the start of the subscription.

Subscriptions for magazines shipped outside of Germany, Austria and Switzerland start retroactively from the beginning of the calendar year.

Magazine subscriptions are not for a fixed term; they end when you or we cancel them. You or we may cancel magazine subscriptions by adhering to a notice period of three months to the end of the calendar year and the first time the situation arises to the end of the year following the start of the subscription.

Databases
This online shop’s offering is directed at doctors and other self-employed people in healthcare professions (physiotherapists, occupational therapists, naturopaths etc.) in single and group practices, or any other comparable facilities and companies in the healthcare sector. Consumers, as defined in article 13 BGB, cannot purchase a subscription for databases for an indefinite term via this online shop.

You do not purchase ownership to the content concerned, but a simple non-transferable right to usage that entitles you to personal usage of the content. You are not permitted to forward such content to third parties, process, duplicate, reproduce, distribute, publish or make such content accessible to the public, regardless of whether in digital or analogue form.

A password is required to access databases. Any disclosure of the password is prohibited and will lead to the publisher immediately restricting access to any other database you have subscribed to until the subscription period elapses.

Special software might be required to display database content. Please see information about this on the database pages. This software is not part of our contract with you, will not be supplied by us and can be subject to its own licensing and usage conditions.

Shipping and delivery


General delivery information
All products in stock, except magazines, e-books and other downloaded products, will usually be sent to you within 2 to 3 working days after receipt of the order by our service provider KNV Zeitfracht GmbH, Industriestrasse 23, 70565 Stuttgart, Germany. Products that cannot be delivered straight away will be reserved and delivered within 1 to 3 working days after such products have reached our warehouse. Orders of products not yet published will be reserved and delivered to you within 1 to 3 working days after the publishing date. If delays in delivery occur, you will receive information from our service provider stating the probable delivery date.

You will incur no additional shipping costs as a result of partial deliveries.

E-books and other downloaded products
Our service provider KNV Zeitfracht GmbH, Verlagsauslieferug, Industriestrasse 23, 70565 Stuttgart, Germany, will provide the products to download. After payment has been received, you will receive a download link on the order-confirmation page and this link will also be sent to you by e-mail. You can download the products on your standard browser, i.e. no special browser or additional program is required. Please note that if the download is interrupted, the whole file will have to be downloaded again.

E-learning courses on providing information to patients:
You will receive an access code on the order confirmation page after successfully placing your order. This will be sent to you by e-mail. Magazines
Magazines will be shipped directly from the printers within 3 working days after the magazines have been published. In the case of issues which have already been published when the delivery is placed, the printers will also supply the product within 8 working days.

Shipping costs
Except for magazines, no shipping costs are charged for products sent within Germany. When products are sent outside Germany, shipping costs are charged as specified below. We charge the following shipping costs for books:

Prices, billing and payment options


Prices
In Germany, all prices include VAT at the statutory rate (7% for books, e-books and magazines, 19% for all other items). When products are shipped outside Germany, please see the VAT rates in this table.

Invoicing
Invoicing, even for mixed orders, is carried out by the service provider stated (see the section on “Shipping and delivery”).

Payment options
As a registered customer, you can choose one of the following payment options as the default. You can change this any time in the “my account” (“Mein Konto”) section. Please note that any orders already dispatched are processed based on the payment option entered when the order was shipped. Please note that not all the payment methods are always available. There may be restrictions due to the type of media selected (e.g. e-book) or after a credit check has been carried out.

Invoice:

We send an invoice with all books shipped. The invoice will include all the details required to settle it.

SEPA direct debit:

Payments by SEPA direct debit are convenient and safe. If payment via a SEPA direct debit has been agreed, the pre-notification period is one calendar day.

Credit card:

Payment by credit card is the easiest option for orders placed from abroad. You can pay using MasterCard ,VISA, and American Express. Credit card details are not stored, but entered by you on the Six Saferpay credit card company’s page. Therefore, you cannot add credit cards as the default payment options. After entering your data, you will return automatically to our online shop.

PayPal:

Instead of paying by credit card, you can also use PayPal. You must already be registered with PayPal or register, legitimise yourself with your access data and confirm payment instructions to us. To do so, you will be redirected to the PayPal page, where you enter your data and confirm payment. Therefore, it is not possible to add PayPal as the default payment option. Afterwards, you will return automatically to our online shop.

Advance payment:

You can also select advance payment as an option. In this case, we will wait until your payment has been received and will only process your order then. In certain circumstances, in addition to a credit card or PayPal, advance payment might be the only payment option possible, for example when you purchase an e-book from us, the products exceed a certain value, or the order is placed in countries outside Germany, Austria, Switzerland, Luxembourg or Liechtenstein. When the order has been received, in cases where invoices are still unpaid and reminders have been issued, we also reserve the right to require advance payment to cover the value of the order. The same applies if the value of all orders exceeds the total of invoices still unpaid, or orders already dispatched exceed a certain figure when another order is placed.

In most cases, you will receive a paper invoice from Georg Thieme Verlag KG or the service provider concerned. To improve service and due to environmental reasons, we are increasingly switching to e-billing. Should you prefer a paper invoice, please let us know here: kundenservice.thieme.de.

Retention of title


The products shipped remain our property until they have been paid for in full.

Liability for defects


For all products from our shop, you have guarantee rights in line with statutory provisions should such products be faulty.

Capturing, processing and using your customer data, data protection


Your data will be used in compliance with our data-protection provisions, which you can look at here.

Caution


Just like all sciences, medical progress is ongoing. Research and clinical experience add to our expertise, particularly where treatment and therapy using medication are concerned. Should a dosage or application be mentioned, the reader can rely on the fact that the authors, editors and publishers have carefully ensured that these details are state of the art at the time the product has been completed. The publisher can accept no liability for details regarding dosages and types of application. All users must ensure after carefully checking the leaflet enclosed with the product used and, if necessary, after consulting a specialist that the dosage recommendations given there, or the observance of contra-indications are different from what is stated in this book. It is particularly important to check these details for medication that is used rarely or types of medication that are new to the market. Any dosage or application is at the user’s own risk. Authors and the publisher call on all users to inform the publisher of any inaccuracies they might identify.

Protected product names (brands®) are not especially marked as such. The lack of such an indication does not therefore signify that a product’s name is not protected. The book, including all parts therein, is protected by copyright. Any usage outside the stringent limitations of the German Copyright Act (Urheberrechtsgesetz) is not permitted without the consent of the publisher and is a criminal offence. Such stipulation applies especially to duplications, translations, microfilms, storage and processing in electronic systems.
